In April, Oklahoma County prosecutors decided not to charge Ferguson after he was accused of what is apparently the same rape. “Evidence to support the reporting person’s allegations that the sexual conduct was not consensual was absent,” District Attorney David Prater said at the time. According to the lawsuit, the woman alleged that in 2018 she and Ferguson were in a consensual relationship. During the relationship, Ferguson allegedly pressured the woman to participate in a threesome with him and his brother, Brandon Willis, who lives in Dallas.

According to the lawsuit, Ferguson allegedly filmed the assault without the woman’s permission and shared the video with third parties on Snapchat. The woman brought the civil claims for the “physical, emotional and psychological” injuries she has suffered, according to the lawsuit. Ferguson, 22, has played three seasons for the Thunder since being selected 21st overall in the 2017 NBA Draft. “As we previously communicated, we were aware of the matter, have followed all protocols, and continue to respect the legal process,” a Thunder spokesman said.
